Welcome to B2B Pay, S.L.

B2B PAy, S.L. (hereinafter B2BPay) respects your privacy. We offer services that allow platforms and companies to formalize contracts with each other and make payment transactions in a secure manner.

The aim of this policy is to inform you about the different services offered by B2BPay through its website www.b2bpay.eu and which affect your personal data in accordance with the provisions of Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights and Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016.

Persons responsible for personal information

B2B Pay, S.L. with address in Calle del Carmen, nÂș 79, entresuelo E, 03550 San Juan de Alicante (Spain) and C.I.F. B-01999366, is responsible for the processing of the personal information collected and treated through the services of B2BPay.

Data we process

We process the personal data that you provide to us, as well as other data generated in the context of your activity on our platform, such as the operations that you perform, provided that such collection is permitted by law

The collection and use of personal data is essential to help us ensure that our services are secure and compliant. In the context of fraud monitoring, prevention and detection services, we may monitor information and patterns of payment transactions and other online signals to reduce the risk of fraud, money laundering and other activities harmful to us and our customers.

Please note that the information indicated as mandatory is essential in order to finalize the contract, charge the buyer and pay the seller, so if you do not provide it, it will not be possible to process your transaction on our platform.

What personal information does B2BPay collect?

We collect your personal information to provide and continuously improve our services.

These are the types of information we collect:

  • Information you provide us with: We receive and store all the information you provide to us in connection with B2BPay services. You can choose not to provide certain information, but if you do so, you will not be able to enjoy the B2BPay service.


    Personal data is any information that relates to an identified or identifiable person. The personal data you provide directly through our platform will be evident in the context in which you provide the data. In particular:

    • When you register for a B2BPay account, we collect your email address and account login credentials.
    • When you register to become a B2BPay customer, we collect your personal data such as full name, email address, job title and identity documents as well as your company details.
    • When you complete our online form to accept the sales contract, we collect all the details of the products you are going to buy or sell, as well as their price.
    • If you contact us by phone, we will collect the phone number you use to call B2BPay. If we contact you we may collect additional information to verify your identity.
    • If you are a B2BPay customer, when you make payments by transfer through our platform, we will receive your transaction information. The information we collect will include information about the payment (such as bank account information), the amount of the purchase and the date of payment.
    • If you are a B2BPay customer, when we make payments to you by transfer through the platform, we will need to collect your bank details.
    • When we conduct financial fraud monitoring, prevention, detection and compliance activities, we will receive personal data from you (and your device) and about you through our service and from our financial service providers, identity verification services and publicly available sources, as necessary to confirm your identity and prevent fraud. Our fraud control, detection and prevention services may collect personal data about you and use technology to help us assess the risk associated with an attempted transaction by you on B2BPay.

  • Automatic information: Each time you use the B2BPay services we automatically receive and store certain types of information, such as usage information, including your interaction with the content and services available through the B2BPay services. For example, like many other websites, we use cookies and other unique identifiers to collect certain information when your Internet browser or device accesses B2BPay services and other types of content offered to you by or on behalf of B2BPay on other websites.

  • Information from other sources: We may receive information about you from other sources.

For what purposes does B2BPay process your personal information?

We process your personal information to operate, provide and improve the B2BPay services we offer to our customers. These purposes include

  • Contract execution and management of collections and payments.. We use your personal information to perform the contract and manage its acceptance, process the buyer's payment and make the payment to the seller and communicate with you if necessary.
  • Provision, problem solving and improvement of B2BPay services. We use your personal information to provide functionality, analyse performance, resolve errors and improve the usability and effectiveness of B2BPay services.
  • Recommendations and customization. We use your personal information to recommend features, products and services that may be of interest to you, identify your preferences and personalize your experience with B2BPay services.
  • Compliance with legal obligations. In some cases, we have a legal obligation to collect and process your personal information. For example, we collect information about your tax information for billing purposes.
  • Communication with you. We use your personal information to communicate with you regarding B2BPay services through various channels.

    • Manage, operate and improve the performance of our platform by understanding its effectiveness and optimizing our digital assets.
    • Analyze and advertise our services.
    • Perform aggregate analysis and develop business intelligence that enables us to operate, protect, make informed decisions and report on our business performance.
    • Share personal data with external service providers who provide services on our behalf and business partners who help us operate and improve our business.
    • To guarantee the security of the network and the information on our platform.

Does B2BPay share your personal information?

Information about our customers is a critical part of our business and we do not engage in activities that sell our customers' personal information to third parties. B2BPay only shares its customers' personal information in the manner described below.

  • Group companies. We share personal data with other companies of the group to which B2B Pay, S.L. belongs, in order to provide our services in the best possible way.
  • Third party service providers: We hire other companies and individuals to perform certain functions on our behalf. These third-party service providers will have access to personal information needed to perform their functions, but will not be able to use it for other purposes. In addition, they must treat personal information in accordance with this Privacy Notice and applicable data protection laws.
  • Protection of B2BPay and Others: We disclose personal information and account data of our customers when we believe disclosure is necessary to comply with law, to enforce or apply the Terms of Use and other agreements, or to protect the rights, property, or safety of B2BPay, its users, or others. This includes exchanging information with other companies and organisations for fraud protection and credit risk reduction.
  • Compliance and damage prevention.We share personal information as necessary: (i) to comply with applicable law or payment method rules; (ii) to enforce our contractual rights; (iii) to protect the rights, privacy, security and property of B2BPay, you or others; and (iv) to respond to requests from courts, law enforcement agencies, regulatory agencies and other public and government authorities, which may include authorities outside your country of residence.


Other than as set out above, you will be informed if any information about you is shared with third parties so that you have the opportunity to opt out of having your information shared.

International data transfers.

B2BPay carries out international data transfers with an adequate level of protection and all the necessary guarantees according to data protection regulations. The authorisation for such transfers is established in article 49 of the RGPD.

Transfers are made to institutions located throughout the European Economic Area. Whenever we transfer personal information to countries outside the European Economic Area, we will ensure that the information is transferred in accordance with this Privacy Notice and as permitted by applicable data protection laws.

Is my personal information safe?

We design our systems and devices with your security and privacy in mind.

  • We work to protect the security of your personal information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.
  • We have physical, electronic, and procedural security systems in place to safeguard the collection, storage, and disclosure of customer personal information. Our security procedures mean that we may occasionally request proof of identity from you before providing you with confidential information.
  • Our devices offer security features that protect them against unauthorized access and data loss. You can control these features and configure them according to your needs.
  • It is important that you protect yourself against unauthorised access by third parties to your password and to your computers, devices and applications. Make sure you log out when you are finished using a shared computer.

Information on third party advertisers and links to other websites

B2BPay services may provide the ability to connect to other websites. These websites may operate independently from us and may have their own privacy notices or policies, which we strongly encourage you to review. If any linked website is not owned or controlled by us, we are not responsible for its content.

Rights

If you have any questions or objections regarding the way we collect and treat your personal information, please contact our Customer Service.

The interested parties may at any time and free of charge exercise their rights to access, rectification and deletion, as well as to request that the processing of their personal data be restricted, to oppose it, to request the portability of their data (where technically possible) or to withdraw their consent, and where appropriate, not to be subject to a decision based solely on automated processing, including profiling.

To do so, you can write to the following e-mail address dataprotection@b2bpay.eu. In any case, your request must be accompanied by a photocopy of your ID card or equivalent document, in order to prove your identity.

If you feel that your rights have been violated with regard to the protection of your personal data, especially when you have not obtained satisfaction in the exercise of your rights, you may file a complaint with the competent Data Protection Supervisory Authority (Spanish Data Protection Agency), through its website: www.agpd.es.

In compliance with the provisions of Article 21 of Law 34/2002 on services of the information society and electronic commerce, if you do not wish to receive further information about our services, you can unsubscribe by sending an email to dataprotection@b2bpay.eu. with subject "LOW".

Security and Retention.

We make reasonable efforts to ensure a level of security appropriate to the risk associated with the processing of personal data. We maintain organisational, technical and administrative measures designed to protect personal data within our organisation against unauthorised access, destruction, loss, alteration or misuse. Your personal data is only accessible to a limited number of our staff who need access to the information to perform their duties. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you believe that the security of your account has been compromised), please contact us immediately.

We keep your personal data as long as we provide you with our services. We retain personal data after we cease to provide our services to you directly or indirectly, even if you close your account with B2BPay, to the extent necessary to comply with our legal and regulatory obligations, and for the purpose of fraud, monitoring, detection and prevention. We also retain personal data in order to comply with our tax, accounting and financial reporting obligations, where we are required by law to retain the data. When we do retain data, we do so in accordance with the mandatory periods prescribed by law.

Are minors allowed to use B2BPay services?

B2BPay's services are not aimed at people under the age of thirteen (18) and we ask that they do not provide personal data through our platform.

How long do we keep your personal information?

The personal data provided will be kept for the time necessary to fulfil the purposes for which they were originally collected.

Once the data is no longer necessary for the processing in question, it will be kept duly blocked so that, if appropriate, it can be made available to the competent public administrations and bodies, judges and courts or the public prosecutor's office, in accordance with the limitation period for actions that may arise from the relationship maintained with the client and/or the legally stipulated storage periods.

Automated decisions and profiling.

The website does not make automated decisions or create profiles.

During the period of processing of your personal data, B2BPay may transfer your data to the following recipients

Judges and Courts; State Security Forces and Corps; and other competent public authorities or bodies, when the person responsible is legally obliged to provide personal data.

  • Provide information in your buyer account, seller account or any other account we make available to you that enables you to develop or offer software, products or services to B2BPay customers.
  • Communicate with us by phone, email or otherwise.
  • Complete any questionnaire within the platform.
  • Provide us with your banking information to make payments to you.
  • Upload files to B2BPay.
  • Use all the alerts that B2BPay makes available to you

By performing the above actions, you are giving us personal information such as your name, company name, addresses, email addresses, corporate, financial and banking information, and device log files and settings.

Automatic information:

These are some examples of the information we collect and analyse:

  • The Internet IP address you use to connect to the Internet with your computer or other device.
  • Username, e-mail address and password for your account.
  • Information about your computer, device and your Internet connection such as the application of the device or the version and type of your browser, the types and versions of your browser connection, the operating system or time zone setting.
  • The location of your device or computer.
  • Information regarding interaction with the content, such as content download data.
  • Device parameters, such as when a device is being used, application usage, connectivity data and any errors or failures.
  • Parameters of the B2BPay services (e.g. the existence of technical errors, your interactions with service and content functionalities, your configuration preferences and backup data, location of your device running an application, data about the images and files uploaded (e.g. file name, dates, times and location of your images)
  • Telephone numbers used to call our customer service.

We may also use device identifiers, cookies and other technologies in devices, applications and our websites to collect browsing, usage or other technical information for fraud prevention purposes.

Accuracy of data

You guarantee that the information you provide is true, accurate, complete and up-to-date, and you undertake to inform us of any changes to the information you provide through the channels set up for this purpose. You will be responsible for any direct or indirect damage that may be caused as a result of non-compliance with this obligation.

In the event that you provide data from third parties, you declare that you have the consent of the interested parties and you undertake to transfer them the information contained in this clause, exempting B2BPay from any responsibility derived from the failure to comply with this obligation.
